The rules (Tips Act 2022)

  • Electronic tips must be distributed fairly and transparently.
  • The employer may NOT retain any share of electronic tips (narrow exceptions: the employer’s own tax/PRSI/USC, card/bank charges, or where the employer does substantially the same work).
  • Tips may NOT be used to make up contractual wages, they are on top of pay.
  • Each employee must get a written statement (total tips in the period + the amount paid to them) within 10 days.
  • Non-compliance carries a fine of up to €750.
